    1. Welcome to the Roomies.com website (the "Site"). These terms & conditions ("Terms and Conditions") apply to the Site, and all of its divisions, subsidiaries, and affiliate operated Internet sites which reference these Terms and Conditions.
    2. For the purposes of this website, "we", "us" and "our" all refer to roomiesconnect.com (RCL).
    3. The Site reserves the right, to change, modify, add, or remove portions of the Terms and Conditions of Use at any time. Changes will be effective when posted on the Site with no other notice provided. Please check these Terms and Conditions regularly for updates. Your continued use of the Site following the posting of changes to these Terms and Conditions constitutes your acceptance of those changes.

We provide this website, further referred to as the "site", for the convenience of Home owners, tenants, room-owners, buyers, tenants, real estate agents, investors and browsers interested in immovable property, and collect content in the form of advertisements from private sellers, subscribing estate agents, letting agents, developers as well as related parties, to display properties they are marketing. We are not estate agents ourselves.
    8. These terms and conditions are deemed to include our privacy policy and are collectively known as "these Terms".
    9. Certain uses of this Site are prohibited and amount to a misuse of our systems and the Site.
    10. For the purposes of this website, "we", "us" and "our" all refer to roomiesconnect.com (RCL).
  2. Use of this site
    1. You confirm that you are at least 18 years of age or are accessing the Site under the supervision of a parent or legal guardian.
    2. Both parties agree that this website may only be used in accordance with these Terms and Conditions of Use. If you do not agree with the Terms and Conditions of Use or do not wish to be bound by them, you agree to refrain from using this website.
    3. We grant you a non-transferable, revocable and non-exclusive license to use this Site, These Terms and Conditions of Use specifically prohibit actions such as: accessing our servers or internal computer systems, interfering in any way with the functionality of this website, gathering or altering any underlying software code, infringing any intellectual property rights. This list is non-exhaustive and similar actions are also strictly prohibited. Any breach of these Terms and Conditions of Use shall result in the immediate revocation of the license granted in this paragraph without prior notice to you.   3. User submission
    1. Anything that you submit to the Site and/or provide to us, including but not limited to, questions, reviews, comments, and suggestions (collectively, "Submissions") will become our sole and exclusive property and shall not be returned to you.
    2. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.
  4. Accessibility of website
    1. Our aim is to ensure accessibility to the website at all times, however we make no representation of that nature and reserves the right to terminate the website at any time and without notice. You accept that service interruption may occur in order to allow for website improvements, scheduled maintenance or may also be due to outside factors beyond our control.
  5. Formation of contract
    1. Both parties agree that browsing the website and gathering information regarding the services provided by the room/apartment owner does not constitute an offer to let, but merely an invitation to treat. The parties accept that an offer is only made once you have selected the property you intend to use, chosen your preferred payment method, proceeded to the checkout and completed the checkout process.
    2. Both parties agree that the acceptance of the offer is not made when the room/apartment owner nor RCL representatives contacts you by phone or by email to confirm that the order has been placed online. Your offer is only accepted when your request is confirmed, and payment is received by RCL's representative. Before your request confirmed, you may be asked to provide additional verifications or information, including but not limited to phone number and address, before we accept the request.
    3. Please note that there are cases when a request cannot be processed for various reasons. The Site reserves the right to refuse or cancel any request for any reason at any given time.
  6. Payment
    1. All Parties agrees that payment shall be remitted to the room/Apartment -owner upon confirmation of the standard of the Apartment suiting its request and there exist no mis-representation as to the standard of the room/apartment given by the room/apartment owner.
    2. All Parties agree that in the event where the lessee (short-term lease)/ the tenant cancels its request after its confirmation within 24hours, it shall remit to the Lessor (short-term lease) 50% payment which is not limited to the agreed fee.
    3. By signing into this website, it is agreed by the room/apartment owner that where there is a mis-representation as to the standard of the apartment/room, it shall be liable to compensate the room/apartment seeker which shall not be unreasonably withheld by the room/apartment owner.
  7. Recovery of property
    1. All Parties agree that upon the expiration of the tenancy tenure, whether a short or long-term lease, the room/apartment seeker shall exit the premises on or before 12noon on the date of expiration. Failure to do this, RCL or its representatives shall have the right to recover the said property from the user.
  8. User convenant
    1. It is agreed that the room/apartment seeker shall uphold the following:
    2. To keep the interior of the property in good and tenable condition.
    3. Shall be liable for any damages incurred during its stay in the said property
    4. To grant the facility managers/its workmen of the property to inspect the property
    5. To abide by all rules and regulations of the property owner
    6. Not to use the property for any illegal activity.
    7. To peacefully yield up the property to its owner upon the expiration of the agreed tenure.
    8. To fix any damaged elements of the apartment which occured during tenure of use of the property or pay the equivalent monitary value to get said element returned to its original state of aesthetics and function.
  9. Mis-representation
    1. RCL shall not be responsible for any mis-representation as to facts, property so listed on its website or information shared by either the Room/Apartment Seeker or owner.
  10. Termination
    1. In addition to any other legal or equitable remedies, we may, without prior notice to you, immediately terminate the Terms and Conditions or revoke any or all of your rights granted under the Terms and Conditions of Use. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and we shall, in addition to any other legal or equitable remedies, immediately revoke all password(s) and account identification issued to you and deny your access to and use of this Site in whole or in part.
  11. Confidentiality
    1. All communications from RCL will provide a clear hyperlink where you can reverse your permission or de-register. If you have any problem with this process, please call +234 (0) 18889205 for assistance.
    2. We intend using any personal or organizational particulars you submit to us via email, telephone, or the submission forms on this site only to respond to any specific request for information you have made on the site, and, with the exception of possible communication and use of this information, will not use this information in any other way or disclose it to any third party without your express written consent, unless forced to do so by law or if such information into the public domain.
    3. In the event where RCL offers or supplies a service to you that is provided on our behalf by a third party we may have to pass your Information to them in order to deliver the service. By using this site, you consent to us providing your Information to the third parties licensed by us to provide such services.   17. Disputes
    1. All disputes in terms of this agreement or relating to the use or inability to use this web site shall be settled in accordance to the Arbitration Rules set out in the First Schedule to the Arbitration and Conciliation Act, Cap. A18, Laws of the Federation of Nigeria, 2004 (the "Arbitration Rules"). There shall be a sole arbitrator appointed jointly by the Parties (or by the President of the Chartered Institute of Arbitrators (Nigerian Branch) if a sole arbitrator cannot be agreed upon by the Parties within ten (10) days of the written notice of a request for arbitration). The seat of the arbitration shall be Lagos, Nigeria and the procedural law of the arbitration shall be Nigerian law. The language to be used in the arbitral proceedings shall be English. All andany awards or other decisions of the arbitrator shall be made in accordance with the Arbitration Rules in writing and shall be final and binding on the Parties. Each Party shall be responsible for its own legal costs.
  18. Whole agreement
    1. This agreement constitutes the whole agreement between RCL and the user, and no terms and conditions that are not expressly stated in this agreement may be implied by either party.
    2. We reserve the right to change this agreement or any part thereof at any time without notice, such changes being deemed to come into effect as soon as they are incorporated in this agreement and viewable on the site.
